Mechanism for preliminary examination of the draft regulations and their compliance with the Convention

We present to your attention a proposal for the Mechanism for preliminary examination of the draft regulations and their compliance with the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR) and the European Court of Human Rights (ECHR).

The Expert report on the Mechanism is prepared by the “Union for Human Rights” POCA (Partnership under the Obligations and Contracts Act) in the implementation of the public procurement of predefined Project №3 “Strengthening of domestic remedies to alleged violations of the Convention on Human Rights and Fundamental Freedoms of the Council of Europe and the capacity for the execution of judgments of the European Court of Human Rights”, with the financial support of the Norwegian Financial Mechanism 2009-201, which beneficiary is the Directorate Procedural Representation of the Republic of Bulgaria before the European Court of Human Rights (PRRBECHR Directorate).

The mechanism is based on a survey and analysis of key acts and instruments of national, European and international law. It contains methods and guidelines for conducting the preliminary review, it presents the institutional aspect on the matter and underlines the need for legislative changes.
